Professionals: USCIS Filing Fees for H-1B Petitions
There are two special USCIS filing fees required for H-1B petitions. These filing fees are in addition to the Form I-129 filing fee required for all non-permanent visas authorizing employment.
H-1B Training and User Fee
This fee is required for a new H-1B petition as well as the first H-1B extension filed by the same employer. While this fee is not required for an amended H-1B petition, it is required for an H-1B change of employer petition.
If an employer has 25 or more full time equivalent employees, the fee is U.S.$1,500.00. If the employer has less than 25 full time equivalent employees, the fee is U.S.$750.00.
The law prohibits an H-1B employer from requiring the H-1B employee to pay the H-1B user fee, a portion of the fee or reimburse the H-1B employer for the fee. If the H-1B employer is found to have violated this rule, the H-1B employer is subject to a U.S. $1,000.00 fine and other restitution.
H-1B Fraud Prevention Fee
This fee is required only for a first time H-1B petition or H-1B change of employer petition. The fee is U.S.$500.00.
None of these filing fees applies to H-1B spouses or dependent children.
